General Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the "General Terms and Conditions") apply to all contracts entered into with Alain Dovat, operating as an individual enterprise under the name Monsieur Alain, whose registered office is located at Avenue du Simplon 35, 1006 Lausanne, Switzerland, and is registered in the Lausanne Commercial Register under the number CHE-271.428.329 (hereinafter referred to as "Monsieur Alain"), with any user (hereinafter referred to as the "Customer"). The Customer acknowledges that these General Terms and Conditions, in their version in force at the time the order is placed, are applicable and form an integral part of the order process.

All contracts concluded through www.monsieuralain.ch are made directly with Monsieur Alain. By clicking the "buy" button, the Customer places a binding order. A binding contract is entered into once the Customer receives the order receipt. If, after the conclusion of the contract, products cannot be delivered either partially or totally for reasons for which Monsieur Alain is not responsible, the Customer is entitled to withdraw from the contract. In such a case, Monsieur Alain will refund payments that have already been made. Monsieur Alain’s performance is an obligation to send. Monsieur Alain’s obligation is fulfilled with the handover of the ordered product to the transport company. After dispatch, the risk of accidental deterioration and accidental loss of the product passes to the Customer. Monsieur Alain is not responsible for any fault of the transport company used.

The prices quoted at the time the order is placed apply. The prices quoted are final prices, i.e., they include the statutory VAT at the time, if applicable. Monsieur Alain is subject to VAT. Shipping costs and any other additional costs are not covered by Monsieur Alain and must be paid by the Customer in full.

Monsieur Alain offers payment via Credit Card and PayPal. Monsieur Alain reserves the right to refuse certain methods of payment or refer a Customer to alternative payment methods. Any costs associated with money transfers are the sole responsibility of the Customer and must be borne by the Customer.

Monsieur Alain offers a return for all purchased products within 14 calendar days of the reception, provided that the products to be returned are unused, in the same condition as when received, and in their original packaging. A return authorization by Monsieur Alain is required before returning any product. To obtain a return authorization, please email info@monsieuralain.ch. Products should not be shipped before receiving authorization. Gift cards and products purchased on sale cannot be returned. Shipping costs and any other additional costs for the return of the product are not covered by Monsieur Alain and must be paid by the Customer in full. Any refunds will be made to the account used for the original payment, after the returned goods have been inspected. An email will be sent confirming the approval or rejection of the refund request. Shipping costs and any other associated costs will not be refunded.

The Customer is required to inspect the delivered products as soon as reasonably possible after receipt and to notify Monsieur Alain of any detected defects within 5 business days by sending a picture of the defect to info@monsieuralain.ch. If this is not done, the products shall be deemed approved. Defects that could not have been detected during proper inspection must be reported immediately upon discovery by sending a picture of the defects to info@monsieuralain.ch. Otherwise, the product will be considered approved with respect to those defects. Monsieur Alain provides warranty by rectifying defects, either through subsequent performance (defect elimination or remedy) or by providing a defect-free replacement item, at his sole discretion. If supplementary performance fails, the Customer is entitled to withdraw from the contract, except in the case of insignificant defects. The Customer's right to a reduction in the purchase price is excluded. The warranty does not cover normal wear and tear, consequences of improper handling, or damage caused by the buyer or third parties, or defects resulting from external factors.

Any potential liability arising in connection with the sale or delivery of Monsieur Alain’s products or the use of this website is limited to the extent permitted by applicable law. The amount of a potential claim due to Monsieur Alain’s liability is further limited to the purchase price of the sold product in question. Monsieur Alain does not assume any liability for descriptions provided by third parties, particularly Customer reviews published within the online shop or on social media platforms.

Should individual provisions of this contract, including these terms, become or be declared invalid in whole or in part, or if any provisions are missing, the validity of the remaining provisions shall remain unaffected. Any invalid or missing provisions shall be replaced by the respective legal regulations.

These General Terms and Conditions and all legal relationships arising hereunder shall be governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. The courts of Lausanne, Switzerland, shall have exclusive jurisdiction over any dispute in connection with these General Terms and Conditions. With regard to consumer contracts, the courts at the consumer's domicile in Switzerland shall have exclusive jurisdiction.

Monsieur Alain reserves the right to change, update, or replace any part of these General Terms and Conditions at any time. Any modifications will be published on www.monsieuralain.ch and will take effect upon publication. Continued use of the website and subsequent purchase of products after such changes constitutes acceptance of the updated General Terms and Conditions.
